Proof of Claim Submission

If you are a Class Member and wish to be potentially eligible for a payment from the proceeds of the Settlement, you must complete and submit a Proof of Claim and Release Form ("Proof of Claim"). To obtain a copy of the Proof of Claim, click here. The deadline to submit a timely Proof of Claim is June 14, 2017.

You may submit your Proof of Claim using one of two methods. Each method is described below, with links to the requirements for each submission. Your submitted Proof of Claim will also constitute full acknowledgement and complete satisfaction of, and full, final, and forever settlement, release, and discharge from the Released Claims each and all of the “Released Parties,” defined as each and all of the Defendants, Craig Cogut, Pegasus Capital Advisors, L.P., RCF Management LLC, T-II Holdings, LLC, and each of their past or present subsidiaries (collectively, the "Affiliate Releasees"), and each of any Defendant's or Affiliate Releasee's past or present directors, officers, employees, partners, insurers, co-insurers, reinsurers, principals, controlling shareholders, attorneys, accountants, auditors, underwriters, investment advisors, personal or legal representatives, predecessors, successors, parents, subsidiaries, divisions, joint ventures, assigns, spouses, heirs, estates, related or affiliated entities, any entity in which a Defendant has a controlling interest, any member of an Individual Defendant's immediate family, any trust of which an Individual Defendant is the settlor or which is for the benefit of an Individual Defendant and/or any member of an Individual Defendant's immediate family, and any entity in which a Defendant and/or any member of an Individual Defendant's immediate family has or have a controlling interest (directly or indirectly).

Whichever submission method you choose, please note that supporting documentation of the transactions and holdings listed on your Proof of Claim is required. Include all required and necessary documentation with your submission. In the event that you submit your Proof of Claim online, you must retain confirmation of such filing, which is provided at the end of the filing process.

If you fail to execute and submit a timely, properly completed and addressed Proof of Claim, your claim may be rejected and you may be precluded from any recovery from the Net Settlement Fund.


Submit Your Proof of Claim Online

To submit a Proof of Claim online, you must complete the online Proof of Claim submission form found here.

It is estimated that this process will take approximately 30 minutes, though it may take longer if you have a large number of transactions. Once you begin the online Proof of Claim submission process, you will not be able to save and return to your session. Your session will time-out after one (1) hour and you will not be able to return to the claims filing process.

Please have all necessary information available and be prepared to complete the process at one time. Required documentation may be uploaded in PDF format only, and each file cannot be larger than 1MB in size.

In order to be timely, Proofs of Claim must be submitted online by June 14, 2017.


Submit Your Proof of Claim by Mail

To submit a Proof of Claim by mail, complete and sign the Proof of Claim in its entirety with all required supporting documentation and postmarked no later than June 14, 2017, to the Claims Administrator at:
